Please do not send sensitive information. We do not ask for sensitive personal information through our Site, such as Social Security numbers, financial account credentials, or health information. Please do not include it in forms, emails, or texts. If you are a healthcare organization, protected health information (PHI) is handled only under a signed Business Associate Agreement and never through our public website forms.

We do not use personal information collected through our Site to train artificial intelligence models.

3. Text Messages (SMS)

  • How you opt in: When you enter your mobile number and check the text message consent box on one of our forms or booking pages, you agree to receive text messages from Whippet Creative, LLC at that number. Consent is optional and is not a condition of any purchase.
  • What we send: Appointment confirmations and reminders, replies to your inquiry, and project or account updates. If you separately opt in to marketing texts, we may also send occasional messages about our services.
  • Frequency and cost: Message frequency varies. Message and data rates may apply.
  • Opt out or get help: Reply STOP at any time to stop receiving texts. Reply HELP for help, or contact us at [email protected] or (901) 272-0230.

Your mobile information stays private. No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. Information sharing with subcontractors that support our services, such as customer service and messaging platform providers, is permitted. All other categories of sharing described in this policy exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties.

4. Cookies and Analytics

Cookies are small files stored by your browser. We use them and similar technologies as follows:

  • Essential technologies: Our hosting and security providers, including Cloudflare, use cookies and similar tools to deliver the Site securely, block spam and malicious traffic, and keep pages loading quickly.
  • Analytics: We use Google Analytics, deployed through Google Tag Manager, to understand how visitors find and use the Site. Google Analytics collects information such as pages visited, time on page, device type, and approximate location. Learn more in How Google uses information from sites or apps that use its services. You can opt out with the Google Analytics Opt-out Browser Add-on.
  • Embedded tools: Our contact forms and booking calendar, our Google review widget, and web fonts may load from third-party servers. These providers may receive your IP address and browser information when a page loads.

You can block or delete cookies in your browser settings. Some Site features may not work properly if you do.

Opt-out signals: We do not sell personal information or use it for targeted advertising. Where required by law, we treat a Global Privacy Control (GPC) signal from your browser as a valid request to opt out of sale and targeted advertising. Because there is no common industry standard for “Do Not Track” signals, our Site does not respond to them.

5. How We Share Information

We share personal information only in these situations:

  • Service providers: Companies that help us run our business, such as website hosting and security, CRM, forms, scheduling, email, and text messaging platforms, analytics, file storage, accounting, and payment processing. They may use your information only to perform services for us.
  • Our team: Employees and contractors who need the information to do their work and who are bound by confidentiality obligations.
  • Legal and safety reasons: To comply with the law, a subpoena, or a court order, or to protect the rights, property, or safety of Whippet Creative, our clients, or others.
  • Business transfers: As part of a merger, acquisition, financing, or sale of all or part of our business.
  • With your direction or consent: For example, when you ask us to coordinate with another vendor on your project.

We do not sell your personal information, and we do not share it for cross-context behavioral (targeted) advertising. Text message opt-in data and consent are never shared with third parties.

6. Information We Process for Clients

When we build or manage websites, CRMs, advertising accounts, email and text message programs, or other systems for our clients, we may handle personal information about our clients’ customers and website visitors. In those cases we act as a service provider (also called a processor). We follow our client’s instructions and our written agreement with that client, and the client’s own privacy policy governs that information. If you have a question about it, please contact the business you interacted with. If you contact us instead, we will forward your request to that client where appropriate.

For healthcare clients that are covered by HIPAA, we handle protected health information only under a Business Associate Agreement and in line with HIPAA requirements.

7. How Long We Keep Information

We keep personal information only as long as needed for the purposes in this policy, including providing services, keeping business and tax records, resolving disputes, and enforcing agreements. When it is no longer needed, we delete it or de-identify it. We keep a record of text message and email opt-outs so we can continue to honor your choice.

8. How We Protect Information

We use reasonable administrative, technical, and physical safeguards to protect personal information, including encrypted connections (HTTPS), access controls, and limiting access to people who need it. No method of transmission or storage is completely secure, so we cannot guarantee absolute security. If a security breach affects your personal information, we will notify you as required by applicable law.

9. Your Choices

  • Marketing emails: Click “unsubscribe” in any marketing email. We process requests within 10 business days. We may still send messages about your consultation or our services to you.
  • Text messages: Reply STOP to any text, or contact us by email or phone.
  • Analytics and cookies: Use your browser settings or the Google Analytics opt-out add-on described above.
  • Updating your information: Email us and we will correct or update your contact details.

10. Your Privacy Rights

Depending on where you live, you may have the right to:

  • Confirm whether we process your personal information and access a copy of it
  • Correct inaccurate personal information
  • Delete personal information you provided or that we hold about you
  • Receive your personal information in a portable format
  • Opt out of the sale of personal information, targeted advertising, and profiling that produces legal or similarly significant effects (we do not engage in these activities)

Residents of states with comprehensive privacy laws, such as California, Colorado, Connecticut, Tennessee, Texas, Virginia, and others, may have these rights to the extent those laws apply.

How to Make a Request

  • Email [email protected] with “Privacy Request” in the subject line, or call (901) 272-0230.
  • We will verify your identity by matching information you provide with information we already have.
  • You may use an authorized agent. We may ask for written proof of the agent’s permission and verify your identity directly.
  • We will respond within 45 days. If we need more time, we will tell you why and may extend by up to 45 more days where the law allows.
  • We will not discriminate against you for exercising your privacy rights.

How to Appeal

If we decline your request, you may appeal by emailing [email protected] with “Privacy Appeal” in the subject line. We will respond in writing within 60 days and explain our decision. If you are not satisfied with the outcome, you may contact your state Attorney General.

California Residents

We do not share personal information with third parties for their own direct marketing purposes.

11. Children’s Privacy

Our Site is intended for businesses and adults. It is not directed to anyone under 18, and we do not knowingly collect personal information from children or minors. If you believe a minor has given us personal information, please contact us and we will delete it.

12. Third-Party Links

Our Site links to other websites, such as LinkedIn, Google, and websites we have built for clients. We are not responsible for the privacy practices of those websites. Please review their privacy policies.

13. Visitors Outside the United States

Whippet Creative is based in the United States. Your information may be processed and stored in the United States and in other countries where we or our service providers operate. Privacy laws in those places may differ from the laws where you live.

14. Changes to This Policy

We may update this Privacy Policy from time to time. When we do, we will change the “Last updated” date above. If we make material changes, we will provide notice on our Site or contact you directly before the changes take effect where required by law.
